These terms are an agreement between you and Polemarch AI ("we", "us"), the provider of BigBoard AI, powered by Recap AI (the "Service"). By creating an account or continuing to use the Service you agree to these terms. If you accept on behalf of an organisation, you confirm you have authority to bind it; otherwise you confirm you are of legal age.
The Service records audio and video you capture, produces transcripts, AI summaries, action items and derived artifacts (decks, PDFs, pages, flyers, social posts), hosts live rooms, and can operate an AI concierge agent on your behalf. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you select.
You are responsible for obtaining consent from everyone in the room or on the call before recording, wherever you are. Transcripts, summaries and agent responses are generated by AI, may be inaccurate, and are not professional, legal, medical or financial advice. Verify anything important before acting on it.
You must not misuse the Service. In particular you must not:
You are responsible for your prompts and inputs, for having the rights to any content you upload, and for how you use outputs. We may remove content, filter or refuse outputs, and suspend accounts to enforce these rules. Rights holders can report infringing content to deon@polemarch.site; repeat infringers lose access.
Keep your credentials confidential; you are responsible for activity under your account. Provide accurate information and keep it current.
We retain all rights in the Service, its software, documentation and branding. You retain ownership of your recordings, notes and uploads, and grant us a limited licence to host and process them solely to provide the Service.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations and refunds are governed by the Paddle Buyer Terms and our Refund Policy. Subscriptions renew automatically for the same period until cancelled.
We do not guarantee that the Service will be uninterrupted, timely or error-free. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
To the extent permitted by law, our aggregate liability is limited to the fees you paid in the twelve months before the claim, and we exclude indirect, consequential or special damages including loss of profits, data or goodwill. Nothing limits liability for fraud, death or personal injury caused by negligence. You indemnify us against claims arising from your content, your unlawful use, or your breach of these terms.
We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations. You may stop using the Service at any time. On termination you may export your notes for 30 days, after which your data may be deleted.
These terms are governed by the laws of the State of New York, United States, and its courts have exclusive jurisdiction. You may not assign this agreement without our consent; we may assign it in a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms and will post the revised version here.
